UNDERSTAND UK IMMIGRATION ROUTES

PERMISSION TO ENTER THE UNITED KINGDOM

UK immigration law has a big impact on who can enter, stay, study, work, start a business, or join family in the UK. For employers, it also affects hiring, sponsoring, and stopping illegal work. SI Law Solutions breaks down these subjects into easy-to-understand educational paths so visitors can figure out the best way to go, what’s involved, and what questions they should ask before taking any action.

WHAT YOU NEED TO KNOW

Immigration law is a set of rules that govern how people can come to live, work, or stay in the UK. It covers everything from getting a visa to getting a work permit, family reunification, asylum, and even becoming a citizen.

Right of adobe in the UK

British citizens have the right to live in the UK. So, if a British citizen leaves the UK, they can come back anytime they want and enter the UK through an airport or a port. If they show proof that they have this right, usually with a British passport, they don’t have to go through immigration checks. This also applies to British citizens who were born outside the UK and are coming to the UK for the first time. Also, some people from other Commonwealth countries have the same right to live in the UK.

Entry clearance, permission to enter and permission to stay in the United Kingdom

The UK immigration system has three main steps. First, you need to get entry clearance before traveling to the UK. This means you need to have pre-travel permission or an official document like a visa or entry certificate. Most people who want to stay for more than six months need this. Second, when you arrive in the UK at the port of entry, you’ll get permission to enter. Third, if you need to stay longer than the initial limited time, you’ll need to apply for a permanent residence permit.

Visa nationals

Chuung is from China and is a visa national. He wants to come to the UK for a holiday. If he’s allowed to enter, he’ll need to do two things: First , get a visa in China before he travels. Second, when arriving in the UK, he’ll need to convince the immigration officer that he’s really just there to visit.

A ‘visa national’ is someone who always needs to get a visa before travelling to the UK. They need to get a visa from the British High Commission or embassy in their home country before they can enter the UK. The visa will state why they’re going to the UK, such as to visit or study.

Non-visa nationals

A non-visa national is an individual who is not included on the visa list. They do not necessitate entry clearance in advance of traveling to the United Kingdom for short-term purposes, such as a temporary stay of up to six months, as a visitor. However, they will require it for long-term purposes, including stays exceeding six months, such as employment or business-related activities, or permanent residency in the United Kingdom.

Settlement

An individual with settlement status, also known as ‘settled status’ or indefinite leave to remain (ILR), or unconditional leave, permanent stay, or permanent residence, does not possess the right of abode in the United Kingdom. Consequently, in theory, they could potentially be deported. This individual is legally residing in the UK without any conditions or restrictions imposed on their stay. Therefore, their residence is not subject to any time limitations. Upon leaving the UK, an individual with settled status will be subject to immigration control upon their return. This means they will require permission to enter the UK on the basis of their intention to resume residence.

Constructive Knowledge

To prove liability for negligence you need to establish knowledge. For example, if you believe that your employer is responsible for your injury you would have to show that they were aware of the threat and did not take any reasonable steps to avoid it.
